When a manufactured product fails catastrophically, it often causes severe injuries, or worse, to the individuals using the product or bystanders. When the failure is caused by a defect in the design of the product or in the way it was manufactured, or if the injury results from an inadequate warning, the injured individuals may be entitled to compensation from anyone who had a hand in placing the defective product in the stream of commerce – from the manufacturer to the distributor to the wholesaler to the retailer.
A dangerous defect may be present in the product because the manufacturer was negligent in the manner it designed, manufactured, or tested the product. That’s bad. That’s called “strict liability.”
